The facts are not disputed. Joint School District No. 1, the plaintiff, comprises certain areas in both Trempealeau and Buffalo
Counties. During the 1953-1954 school year a number of students of Buffalo County living outside the district attended its
school. Prior to August 1, 1954 the clerk of the district filed with the county clerk of Buffalo County a claim for tuition
based upon the attendance of those Buffalo County students. Other districts which had also admitted Buffalo County students
filed similar claims. Some of these latter were Buffalo County districts which had also admitted county residents not living
in the area of Joint School District No. 1. At a meeting held on August 12, 1954, the Buffalo County School Committee allowed
all claims for tuition filed by high school districts located in Buffalo County in an amount in excess of the amount prescribed
in sec. 40.91, Stats. but refused to allow the claim of the plaintiff and those of other districts outside of Buffalo County
in amounts exceeding that so provided. Upon petition of plaintiff district a writ of certiorari was obtained requiring the Buffalo County School Committee and the
county clerk to meet the challenge of the plaintiff that they had acted arbitrarily and without valid reason in distinguishing
between districts located within and those located without Buffalo County. The petition for the writ demands that the action
of the school committee be reversed and that plaintiff's claim be allowed as presented. By judgment entered on December 1,
1954 the writ was quashed and the action dismissed.
